Award in Legal Frameworks for Social Enterprises

This module provides an overview of the development of legal frameworks in the EU with particular reference to the different structures available in the different countries. It comprises six sessions, namely:-

1. Theoretical Concepts and Legal Structures

2. Suitability and Appropriateness of a Legal Framework

3. Designing Legal Frameworks for Social Enterprises – OECD

4. The Belgian Case: Three Legal Frameworks for Social Entrepreneurship:

5. The Maltese Case: Social Enterprise Act, Malta

6. Comparative Analysis of Legal Frameworks

It provides an overview of the concepts of Social Entrepreneurship in the EU with specific reference to published articles and EC documentation on the matter. It includes a review of some of the Legal Frameworks available in the EU with particular reference to Malta and Belgium.  It provides a comparative analysis of the legal frameworks in the EU highlighting differences and similarities of some key jurisdictions.

Learning Outcomes:

At the end of the module/unit the learner will have acquired the following skills:

1. Apply the knowledge and competences acquired to prepare for the setting up of a legal structure for a Social Enterprise
2. Create an assignment brief for a legal specialist to set up an appropriate legal structure for a Social Enterprise.
3. Prepare the relevant support documentation for a legal team to establish the appropriate legal structure for a Social Enterprise.
4. Prepare the relevant briefing documents for management and staff outlining the underlying benefits of the most appropriate legal framework and the main risks that need to be taken into consideration.

Each module will be assessed based on the following components:

1. Quality of Contributions in Forums: 20%
   • Evaluation of participation and the quality of insights shared in online discussion forums.
2. Quality of Contributions in Tutorials: 20%
   • Assessment of engagement and contributions during tutorial sessions.
3. Assignment/Case Study: 60%
   • Completion and quality of assignments that demonstrate understanding and application of the course material.

Passing Criteria:

• Students must achieve an aggregate of 50% or higher across the three components to pass each module.

Scholarship Schemes for Maltese residents:

• MySkills Scheme: Malta residents are eligible for up to 80% reimbursement, capped at €5,000, subject to eligibility criteria. International students would be able to apply for the MySkills Scheme once they obtain their Student Temporary Residence Card (TRC). (For individual modules only)
• Get Qualified Scheme ( Scheme available for Maltese residents ) – 70% refund of course fee as a tax rebate
